No, you should not use Klaviyo or Mailchimp to send unsolicited marketing emails to a cold prospect list. Their published rules require permission. Being able to upload a CSV or trigger a campaign does not establish that the intended use is allowed.
The useful distinction is between prospect research, a sales conversation, and a subscribed marketing audience. Each needs its own status and workflow. This guide reviews the platform rules as of October 15, 2026 and explains how to keep those workflows separate.
What Klaviyo permits
Klaviyo's Acceptable Use Policy, updated April 9, 2026, prohibits unsolicited messaging whether sent in bulk or individually. It also restricts purchased, rented, third-party, publicly available, and non-consenting contacts, along with messaging people who have unsubscribed.
That makes a researched B2B prospect list unsuitable for a Klaviyo marketing campaign when the recipients have not consented. Personalizing the message or using a business address does not resolve the missing permission.
What Mailchimp permits
Mailchimp's permission guidance requires express, verifiable consent for marketing communication. Its list examples distinguish a purchased or third-party attendee list from people who knowingly signed up to hear from your company.
The list examples also discuss existing customers and note that local requirements may differ. Do not turn a prior interaction into a blanket assumption that every type of marketing message is appropriate. Preserve the context and evidence of what the person agreed to receive.
Platform policy and applicable law are separate checks
A platform's permission requirements apply to using that platform. Separately, your team needs to assess the requirements that apply to the audience, location, channel, and message. A general claim that B2B outreach is allowed somewhere does not override a vendor's terms.
This article answers the platform-selection question. It does not establish that a specific campaign is lawful in every market. Resolve the requirements for the actual campaign before launch, rather than treating software selection as compliance approval.
A practical routing table
Use a record-level decision before importing contacts into an email platform. The following is an operational review framework, not a substitute for checking the applicable rules.
| Contact situation | Next step |
|---|---|
| A researched prospect with no marketing permission | Keep out of subscribed marketing audiences; assess any separate outreach workflow |
| A person who knowingly signed up for your newsletter | Record the signup evidence and route to the relevant subscribed audience |
| A trade-show list supplied by an organizer | Verify permission to hear from your company before any marketing import |
| A prospect who asks for one document | Fulfill that request without automatically enrolling them in a newsletter |
| A person who opts out | Apply suppression before any further automated campaign activity |
| A record with unclear permission history | Hold for review rather than guessing |
The purpose is to prevent a convenient integration from silently making a messaging decision. A “contact created” event is not the same as a “marketing subscription approved” event.
Where Clay belongs in this workflow
Clay can help organize company research and contact data. Enrichment does not create permission. A verified email address tells you something about the address, not whether the person subscribed to your marketing.
Keep separate fields for research evidence, contact verification, subscription evidence, suppression status, and campaign approval. Avoid a single “ready” column that hides these different decisions.
For example, an enriched company record might be approved for account research while its contact remains excluded from marketing campaigns. A later explicit signup can be recorded with its own timestamp and source. The system should preserve both events without rewriting the history.
Our Clay consulting agency helps design these handoffs so data preparation and campaign entry have clear rules.
What to evaluate for a separate outbound program
If a permitted B2B outreach program is part of your strategy, evaluate tools designed around sales sequences and replies. Smartlead, Instantly, and Lemlist are possible products to assess. Their availability does not make every list or message acceptable; review their terms and your campaign requirements.
Compare operational behavior rather than claims of effortless delivery:
- Can you prevent suppressed records from entering a campaign?
- What happens when someone replies or requests no further contact?
- Who owns the conversation and the next action?
- Can the team inspect the research behind a personalized statement?
- Are campaign history and opt-out status preserved across imports?
- What is the complete cost, including data, infrastructure, and operator time?
Our Instantly vs Lemlist comparison and Smartlead plan guide help frame those buying questions.
If cold prospects are already in your marketing audience
Pause the affected campaigns and inspect how the records entered the system. Preserve existing suppression and permission history. Separate records with documented permission from those without it, and review any automations that can enroll the latter.
Check integrations as well as manual imports. A CRM sync, form workflow, or enrichment job may be repopulating an audience after a one-time cleanup. Assign an owner to the routing rule and test it with sample records before restarting affected activity.
Do not mark everyone as subscribed to make an import pass. The software field should reflect the underlying evidence, not create it.
Questions to ask an agency
A cold email agency should be able to explain where prospect data comes from, which systems hold subscription evidence, and how suppression is shared. Ask to see the workflow rather than accepting a claim that the tool makes the campaign compliant.
If the engagement includes LinkedIn lead generation, agree on how conversations and contact preferences affect other channels. Keep qualification definitions and reply ownership consistent across the program.
Frequently asked questions
Can I use Mailchimp for cold emails if I personalize them?
Personalization does not establish marketing permission. Assess the audience against Mailchimp's published requirements before sending.
Does a Clay-enriched or verified address count as a subscriber?
No. Research and address verification are different from a person's decision to receive marketing. Keep those statuses separate.
Can I move an interested sales reply into a newsletter?
An interested reply is not automatically a request for recurring marketing. Record what the person agreed to and use an appropriate signup process for the newsletter.
Is a cold email platform automatically compliant?
No. You still need to evaluate the intended use, applicable requirements, and platform terms. A product subscription is not campaign approval.
